This Agreement is a License Agreement between you and Borg Design. Please read carefully the terms and conditions of this Agreement before installing the program. License Agreement

Software License Agreement for the Expert Email Validator Program

This Agreement is a License Agreement between you and Borg Design. Please read carefully the terms and conditions of this Agreement before installing the program. Installation of the program implies your agreement with the terms and conditions. If you do not agree with the terms and conditions of the present Agreement, please do not install the program.

1. Copyright

This software program ("the program") is owned by Borg Design. This program is protected by international conventions, copyright laws as well as other intellectual property laws and treaties.

2. License

Borg Design grants you the right of using this program on a single PC, terminal or workstation in a local area network at a given moment. Using this program on more terminals or workstations simultaneously requires the acquiring of another license from Borg Design (including a suplimentary serial number).

3. Copy Restrictions

A. This program and the written documentation are the property of Borg Design and are protected by copyright laws. You can make a backup copy or archive. Any other copy of the program or of the written documentation is strictly forbidden.

B. You may not reverse engineer, reverse compile, disassemble, copy, transfer or otherwise attempt to create the source code from the Program.

4. Restrictions regarding usage

You may not sell, rent, disclose, provide, or otherwise make available data to any third party without the prior written consent of Borg Design.

5. Duration

This license is effective until terminated or until Borg Design loses its rights over the program. You may terminate this license at any time by destroying the program, documentation as well as each backup copy. Borg Design may terminate this license without warning if you fail to comply with the terms and conditions of this license agreement. In such event, you must destroy all copies of the program and all of its component parts (including modified parts).

6. Disclaimer of Warranties

Users of Expert Email Validator must accept this disclaimer of warranty: "Expert Email Validator is supplied as is. Borg Design disclaims all warranties, expressed or implied, including, without limitation, the warranties of merchantability and of fitness for any purpose. The author assumes no liability for damages, direct or consequential, which may result from the use of Expert Email Validator. BORG Design DOES NOT OFFER ANY OTHER FORMAL OR IMPLIED WARRANTY FOR THE PACKAGE, THE ACCOMPANYING DOCUMENTATION OR THE COMERCIAL QUALITY OF THE PRODUCT. NO INFORMATION OR ADVICE GIVEN BY BORG Design THROUGH ITS DISTRIBUTORS, AGENTS OR EMPLOYEES CAN BE CONSIDERED A WARRANTY."

7. Disclaimer of Liability for Indirect Damage

IN NO EVENT WILL BORG Design BE LIABLE FOR ANY DAMAGE, INCLUDING LOST REVENUE OR DATA OR ANY OTHER FINANCIAL LOSS OR OTHER DIRECT OR INDIRECT DAMAGES ARISING OUT OF YOUR USE OR IMPOSIBILITY TO USE THE PROGRAM OR OUT OF YOUR INABILITY TO USE THE PROGRAM OR DOCUMENTATION OR OUT OF THE WAY IN WHICH YOU USE THEM EVEN THOUGH BORG Design WAS WARNED ABOUT THE CONTINGENCY OF SUCH DAMAGES. IN ANY CASE, THE ACCOUNTABILITY OF BORG Design CANNOT BE GRATER THAN THE ACTUAL AMMOUNT OF MONEY PAID FOR PURCHASING THE PROGRAM.

8. Miscellaneous

This Agreement is settled by Romanian laws. If any of the stipulations of this Agreement should prove to be illegal, null, or by any other means unenforceable under applicable law, then the availability or applicability of its other stipulations cannot be affected. This Agreement constitutes the entire agreement between you and Borg Design replacing and nullifying any other prior proposal or agreement (written or verbal) regarding the contents of this Agreement.
